Washington, D.C. – The Natural Products Association (NPA) issued the following statement today in response to a decision by the U.S. District Court in the Eastern District of New York to dismiss without prejudice the NPA’s lawsuit seeking a preliminary injunction against a new law in New York that would prohibit the sale of certain dietary supplements to consumers under the age of 18. NPA actively opposed the legislation and was the first trade association to seek legal relief from its consequences.
“We are disappointed in this ruling but believe there is still an opportunity to block the damaging effects of this misguided law. We are weighing all of our options because we are determined to protect consumers and our industry from these baseless attempts to limit the sale of these natural products to people who want to purchase them,” said Daniel Fabricant, Ph.D, President and CEO of NPA.
NPA succeeded in securing a veto from New York Governor Kathy Hochul in 2022 on similar legislation.
